TWENTY-SEVENTH LEGISLATURE, 2013

STATE OF HAWAII

S.B. NO. 699

A BILL FOR AN ACT

 
RELATING TO ANIMAL TRANSPORT. 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

      SECTION 1.  Chapter 142, Hawaii Revised Statutes, is amended by adding two new sections to be appropriately designated and to read as follows:

     "§142-     Transport of animals by air.  (a)  No person shall transport an animal by air to, from, or within the State, except in compliance with this section and the live animals regulations established by the International Air Transport Association.

     (b)  Food and water shall be given to coldblooded animals within eight hours of delivery to the carrier and to warmblooded animals within two hours of delivery to the carrier, unless otherwise required by law or specified by International Air Transport Association regulations.

     (c)  A feeding or watering certification shall be completed in duplicate documenting the date and time of last feeding and confirming compliance with subsection (b).  One copy of the certification shall be attached to the top of the animal container and the other copy to the air waybill.

     (d)  Cargo holding area temperatures where live animals are kept shall not exceed eighty-five degrees Fahrenheit;

     (e)  For shipments of live non-domesticated wild birds, a live wild bird certification shall be completed by the shipper and accompany the air waybill certifying that the live non-domesticated wild birds being shipped:

     (1)  Were born or bred in captivity on special farms; or

     (2)  Are shipped from and to a zoo, sanctuary, preserve, government wildlife agency, or rehabilitation center.

     §142-     Transfer of animals from cargo hold.  Within twenty minutes of the block-in of an arriving aircraft, the carrier shall transfer any animal from the cargo hold of the aircraft to the department of agriculture airport office for transpacific arrivals or to the baggage claim area for interisland arrivals.

     For the purpose of this section, "block-in" means the moment the wheels of an arriving aircraft are stopped and chocked upon landing."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
