AS INTRODUCED
An Act relating to game and fish; prohibiting breeding or failure to prevent breeding of certain animals; listing animals that shall not be bred; exempting certain accredited facilities; prescribing punishment for violation; providing for codification; and providing an effective date.
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 7-802 of Title 29, unless there is created a duplication in numbering, reads as follows:
A. It shall be unlawful to intentionally or negligently breed, propagate, or reproduce, or fail to prevent the breeding, propagation, or reproduction of the following species:
1. Lion (Panthera leo), tiger (Panthera tigris), leopard (Panthera pardus), clouded leopard (Neofelis nebulosa or Neofelis diardi), snow leopard (Panthera unicia), jaguar (Panthera onca), cheetah (Acinonyx jubatus), caracal (Caracal caracal), serval (Leptailurus serval), cougar (Puma concolor), or any hybrids of this list; or
2. Any species of nonhuman primate.
B. Subsection A of this section shall not apply to any facility that is accredited by the Association of Zoos and Aquariums (AZA) or any AZA-certified related facility, provided those facilities prohibit public contact with any animal of any species or hybrid listed in subsection A of this section.
C. Any person who violates this section shall be guilty of a misdemeanor and upon conviction, shall be punished by a fine of no less than One Hundred Dollars ($100.00) and no more than Two Thousand Dollars ($2,000.00) or by imprisonment in the county jail for a period not to exceed thirty (30) days, or by both fine and imprisonment.
SECTION 2. This act shall become effective November 1, 2012.
